Premises liability is an area of the law dealing with the duty that an owner or manager of a commercial business or residential property owes to customers, visitors or guests on the property. Property owners and managers cannot be held responsible for every injury that occurs on their property, but they are responsible for maintaining the property in a safe condition. If they knew or should have known about a dangerous condition, they can be held liable for any personal injury or death that results.

Types of Premises Liability Claims

A variety of dangerous conditions or accidents can result in premises liability claims, including:

  • Assaults and attacks: including rapes, muggings and assaults in parking garages, parking lots, motels, hospitals, apartment buildings or other areas caused by lack of security or inadequate security, lack of outdoor lighting or other dangerous conditions.
  • Slip and fall injuries: caused by slippery floors, broken stairs, unsafe balconies, uneven pavement, sidewalk defects, icy sidewalks, snowy parking lots, potholes, building code violations, poor building maintenance and other dangerous conditions.
  • Dog bites: which cause severe lacerations, puncture wounds or other injuries which may require plastic surgery or other extensive and painful treatment.
  • Swimming pool accidents: including accidental drowning and trampoline accidents.
  • Daycare negligence: resulting in kidnapping, injury to or the wrongful death of unsupervised children.
  • Restaurant liability: including restaurant food poisoning, booth collapses which injure customers, objects in food, health code violations and liquor liability (over-serving liquor).
  • Dram shop litigation: including representing victims of drunken assaults, drunk driving accidents and other accidents which result from the negligent or illegal service of liquor to intoxicated customers in bars, clubs or restaurants.
  • Attractive nuisance: creating an "attractive nuisance" which invites children to play in hazardous or dangerous areas and get injured.
  • Other premises liability accidents: including elevator accidents, escalator accidents, falling objects in retail stores (merchandise falling off shelves), workplace injuries, falls caused by a cleaning supply spills and other accidents.

If your injuries were the result of a premises liability accident, the lawyers at Metzger & Kleiner will pursue any and all sources of compensation. Our investigation may show that a number of parties, like property owners, managers, tenants or manufacturers of dangerous products share responsibility for your loss.
